Protection and Control of Personal Data

The National Institute for Environmental Studies, National Research and Development Agency (NIES) collects the personal data described below to the extent necessary for the smooth operation of the services provided on the GOSAT-GW TANSO-3 Product Archive site (hereinafter the “G3PA Site”), such as providing information and responding to inquiries. The collected personal data will be handled appropriately within the scope of the purpose of use.

Definition of Terms

The definitions of terms in the GDPR Privacy Policy (hereinafter the “Policy") are as follows:

  • GDPR Privacy Policy: The privacy policy provided on the G3PA Site based on the EU General Data Protection Regulation (GDPR) and the relevant privacy laws and regulations including the enforcement laws and regulations of each country.
  • Personal data: Information about an identified or identifiable natural person (hereinafter referred to as "data subject"). On the G3PA Site, information about an individual such as e-mail address that is necessary for the operation of the G3PA Site.
  • Processing: Operations performed on personal data (data collection, recording, editing, storage, modification/amendment, recovery, reference, use, disclosure/provision, alignment, restriction, deletion, etc.).

Scope of Application

The Policy applies to users of the G3PA Site who live or stay within the European Economic Area (EEA).

Personal Data to be Collected

NIES collects the following personal data from users of the G3PA Site and the users who have registered as users on the G3PA Site (hereinafter “Registered Users").

Users of the G3PA Site

  • Information for contact purposes (e-mail address, etc.) only when there is an inquiry from a user of the G3PA Site.
  • Access log (IP address) to the G3PA Site

Registered Users

  • E-mail address
  • Country or region
  • Access log (IP address) to the G3PA Site

When applying for an Authorized User*, in addition to the personal data required for the Registered User application listed in 4. (2) above, personal data such as name, institution/affiliation, and department are required.

Purpose and Legal Basis of Personal Data Processing

When processing personal data, the purpose of use shall be clarified in accordance with Article 6(1) (a) of the GDPR. The personal data shall be processed only with the prior consent of the user and in accordance with the legal basis stipulated in Article 6(1) (b) to (f) of the GDPR, provided, however, that with regard to Article 6(1) (f) of the GDPR, the personal data shall be used within the scope of the following legitimate interests.

  1. Depending on the response to inquiries to the G3PA Site and the content of the inquiries, transfer of the information to the relevant departments in NIES, and to the relevant ministries and agencies (information on inquiries)
  2. Security measures for the server that operates the G3PA Site (IP address)
  3. User authentication when using the services of the G3PA Site
  4. Notification by e-mail from the electronic service of the G3PA Site
  5. Necessary communications with Registered Users (e-mail address)
  6. Reporting in response to requests from public institutions (country or region)

Refusal to Provide Personal Data

You need to register as a user to obtain the data provided on the G3PA Site. If you do not register as a user, we will not be able to provide some of the services.

Disclosure, Provision and Sharing of Personal Data

Personal data provided on the G3PA Site may be disclosed, provided, or shared outside the G3PA Site for the following purposes.

  1. To achieve the purposes described in the Policy, we may disclose, provide, or share the personal data of users to/with the relevant ministries and agencies. When sharing the personal data with the relevant ministries and agencies, we will take the measures prescribed in Article 26 of the GDPR and disclose the information to the user himself/herself.
  2. To comply with EU law or the laws of EU/EEA member countries, we may disclose and provide the personal data of users to the authorities and other disclosure and provision destinations stipulated by the laws.
  3. Cookies may be used to provide services on the G3PA Site and may also be used as anonymous information for statistical analysis etc.

Site Security (SSL description)

The G3PA Site uses SSL (Secure Sockets Layer), an encryption technology, on all pages, and data input flows over the network from your terminal to the server in an encrypted state.

Cookies (Purpose of Use)

The G3PA Site uses cookies to switch the display language between Japanese and English on the G3PA Site, maintain the processing status across multiple pages, and collect information on browsing the G3PA Site. Please see our Cookie Policy for more information.

Transfer of Personal Data Outside the EU

NIES will not transfer any personal data it holds to other countries (outside of Japan).

Personal Data Retention Period

Personal data registered on the G3PA Site will be stored for up to 6 months after the end of the service of the G3PA Site in order to respond to inquiries from users.

Rights of Users of the G3PA Site

The users have the following rights regarding their personal data for using the G3PA site held by NIES.

  1. Right to obtain all necessary information regarding personal data processing (Article 13 and 14 GDPR)
  2. Right to inquire about personal data (Article 15 GDPR)
  3. Right to rectify personal data (Article 16 GDPR)
  4. Right to erase personal data “Right to be forgotten” (Article 17 GDPR)
  5. Right to restrict personal data processing (Article 18 GDPR)
  6. Right to object to personal data processing (Article 21 GDPR)
  7. Right to personal data portability (Article 20 GDPR)

As long as the personal data of the user is processed with the consent of the user, the user has the right to withdraw this consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. (Article 7(3) GDPR)

When a minor becomes a user, the consent by the holder of parental responsibility over the minor is required. (Article 8 GDPR)

The user has the right to lodge a complaint with an information protection supervisory authority regarding the processing of personal data on the G3PA Site. (Article 77 GDPR)

Personal data registered by a Registered User can be corrected by the Registered User from the "User Information Update" button on the "User Information" screen after logging in to the G3PA Site.

If a Registered User wish to stop using the G3PA Site please apply from the "Account deletion" button on the "User Information" screen after logging in to the G3PA Site.

If a Registered User wish to delete the user's personal data, please apply from the "Account deletion" button on the "User Information" screen after logging in to the G3PA Site. The user's personal data will be deleted together with the user's account.

Disclaimer

For information purposes, the G3PA Site may post links to sites other than NIES. Since linked sites have their own policies, please check the policies of the linked sites when accessing them. NIES is not responsible for the content of any linked sites outside NIES, the use of the sites, and their handling of personal data.

Consent to the Policy

By using this web page, we assume that you consent to the Policy of the G3PA Site and the processing methods of personal data described here. Please do not provide us with your personal data unless you agree to the terms of the Policy.

Revision of the Policy

NIES will comply with laws and regulations and other norms related to personal data, and continuously improve our system to protect personal data. When we revise the Policy, we will announce the revision and clearly state the revision date on this web page.
